What is a notary?

A civil-law notary is an impartial official who is authorized to draw up authentic documents, also called notarial deeds. In these deeds agreements between parties, and the consequences of this, are officially recorded. A notary has been appointed by the king and has taken an official oath. In this oath he swears that he will perform his duties fairly, impartially and accurately, that he will comply with the law as punctually as possible and that he will observe strict confidentiality regarding the contents of the deeds drawn up by him. This legislation is laid down in the Notaries Act and is binding on all members and bodies affiliated with the Royal Dutch Notarial Association (KNB).

What does a notary do?

Many notaries on Curacao are supported by notary clerks, who prepare, maintain, check and finishing dossiërs. They further investigations data in the Government and the Chamber of Commerce. How to become a public notary?

To be a notary, you need a bachelor’s and master’s degree to have completed notarial law at a University. This training is offered in Amsterdam (VU), Groningen, Leiden, Nijmegen and Utrecht. Subjects offered include family law, inheritance, matrimonial property law. After finishing the study you can apply for a job at a notary office. The first six years of your career are you a civil law notary, which means that you do not have permission and last character that the notary official end is responsible. Only in case of perception (when the notary is absent), the civil-law notary bears full responsibility.
